The plaintiff, a 36-year-old former California Highway Patrol (CHP) officer was terminated in
1993. She hired defendant law firm to represent her in a discrimination suit against the CHP. The
plaintiff was given a general verdict award for $250,000, but no future economic damages.
Eventually, attorney fees in the amount of $880,000, were awarded. The plaintiff filed a lawsuit
against defendant law firm, alleging legal malpractice and breach of fiduciary duty. The plaintiff
filed for declaratory relief to give her entitlement to the statutory fee award based on the lack of
a written fee agreement.
Injuries
The plaintiff claimed lost future earnings and benefits of $719,042.
Result
The jury returned a defense verdict.
Other Information
Prior to the jury verdict, nonsuit and directed verdict motions were granted as to all causes of action except for the legal malpractice cause of action.
