Facts
The plaintiff and her friend, the defendant, had worked together as certified nurse assistants and then, together
with their husbands, they established and ran a business under the name "At Your Service Registry." The
plaintiffs instituted the suit on the grounds that the defendants, who had financial control of the business, were
misusing business funds for their own personal purposes.
The plaintiffs argued that they had suffered damages as a result of the alleged misdeeds
of the defendants and their lawsuit was for an accounting, breach of partnership, partnership
dissolution and declaratory relief.
Settlement Discussions
Prior to trial the plaintiffs reached a settlement for an undisclosed amount with Vacaville Convalescent. The plaintiffs submitted a demand to the defendants of $35,871. The defendants responded with a C.C.P. Section 998 offer of $2,000.
Damages
