Facts

The plaintiff was the owner of a donut store in Lynwood and argued that donuts that were made
on a machine manufactured by the defendant were greasy and inedible and that the equipment
was defective. The defendant is one of the major manufacturers of donut-making equipment.

Damages

The plaintiff sought to recover the cost of the equipment, plus the cost of the five year store lease, renovations, lost profits, attorney fees and punitive damages, totaling approximately $1 million.

Other Information

After discovery and negotiations, the plaintiffs dropped the fraud claim and not to seek lost profits.
