Facts
On July 5, 2000, the decedent, a 19-year-old disabled male, drowned while on a field trip with several other
summer camp participants. The decedent was known to have suffered from a history of seizures. The facts
surrounding the incident suggested the possibility of a seizure as a factor in the death.
The defendantÆs motion for summary judgment based upon the "seizure liability release"
in the contract with the defendant summer camp was denied.
Settlement Discussions
Initially, the plaintiff sought $150,000. This was reduced to $94,500 by way of C.C.P. Section 998 in the seven days prior to trial. By close of trial, the plaintiff demanded $1.5 million. The defendant offered $25,001 by way of C.C.P. Section 998.
