Facts
The plaintiffs were employees of the city of San Bernardino's Public Works Department. Their assingments were with the street painting section.They stated that in 1995 they informed their new supervisor that various city officials had violated federal and state environmental laws by dumping leftover paint into the city's storm drains that led into the Santa Ana River. The plaintiffs also stated that they had told their new supervisor that the city had been violating health and safety regulations by cutting corners with safety equipment which had the effect of making their lives more dangerous while working on paint jobs. The plaintiffs stated that the City retaliated against them by disciplinary charges that were unwarranted and by imposing unattainable quotas. The plaintiffs stated that when they complained about the difficulty of meeting production quotas, the city countered by increasing the quotas by three hundred percent.
