Facts

The plaintiff, DIRECTV Inc. prepared a vendor check which was stolen out of the United States mail and fraudulently endorsed. The defendant, Citibank, paid out on the check bearing the forged endorsement and did not verify the signature. The plaintiff promptly notified the defendant of the forgery and requested a re-credit to its account of the funds. Citibank refused to re-credit the account despite receipt of an affidavit of forgery.
