In November of 1991, Plaintiffs Michael H. and Shawn A. York purchased a newly constructed residence located on a 10-acre site, for a purchase price of $675,000. The property was marketed as suitable for equestrian uses. Prior to close of escrow, Plaintiffs were informed of the loan appraisal was $550,000. Plaintiffs closed escrow, and 2 years later, sued the seller and real estate broker/agent for negligence and fraud. The seller settled out for $35,000 prior to trial. Claims against the real estate broker/agent were tried.
