Hector Banda, individually, and on behalf of all other similarly situated sued Verizon California Inc. relating to hourly employee wage statements.
Contentions
PLAINTIFF'S CONTENTIONS:
Banda was an hourly employee at Verizon working as a field technician. He alleged the wage statements provided by defendants failed to list the beginning date of the pay period and failed to list the hourly rates and hours worked during the pay period. As a result, he alleged that hourly employees were not paid the correct double time rate and might not have been paid overtime to which they were entitled. He brought a class action, bringing causes of action under the California Labor Code Private Attorney General Act and the Business and Professions Code.
Result
The parties settled for $15 million. Thirty-five percent of the settlement amount was approved for the payment of attorney fees.
