Facts

Plaintiff Christopher Black, an employee of defendant city of Marysville and member of the Marysville Police Officers' Association (MPOA), filed a collective class action against defendant, alleging it failed to compensate him for working overtime hours in violation of the Fair Labor Standards Act (FLSA). The proposed collective group was defined as all people who were MPOA members between May 19, 2003 to the present and who were required to work additional hours without the requisite compensation.

Damages

The plaintiffs sought unpaid overtime hours, liquidated damages, a one-year extension of the statute of limitations, and attorney fees.

Result

On Jan. 23, 2008, the court approved a $120,000 settlement, including $35,000 in wages; $35,000 in liquidated damages; and $50,000 in attorney fees.
