Facts
Thomas Davis and Pamela Davis rented an apartment in the Sundance Apartments where they lived with their children, Rachel and Nathan. On Sept. 14, 2007, the Davises sued Sundance Apartments, James Watt, Catherine Watt, and Watt Property Management, owners of Sundance Apartments, for civil rights violations, deprivation of full use and enjoyment of tenancy, wrongful eviction and emotional distress.
Contentions
PLAINTIFF'S CONTENTIONS:
The plaintiffs asserted that the defendants discriminated against them by segregating families with children from childless tenants and asked about the ages of children before renting apartments. Further, the defendants prevented children from paying on tennis courts and otherwise harassed them.
Injuries
The plaintiffs claimed that they suffered stomach pains, headaches, sleep loss, and appetite loss.
Result
The parties reached a settlement amounting to $45,000.
