Facts
The plaintiff, a former warehouse distributor of truck and automotive parts in Stockton, alleged that two
defendants, United Brake Systems and Midland Brake, gave a secret, unearned discount between 1988 and
1990 on certain brake parts they manufactured or distributed. The plaintiff claimed these discounts went to
favored distributors, including the defendant California Equipment Corporation, in violation of a California
antitrust statute, Section 17045 of the Business & Professions Code.
The plaintiff further claimed that these discounts caused it to lose customers and pushed it into
bankruptcy in 1992.
Damages
The plaintiff asked the jury to award $14 million.

<P>The plaintiff's motions for new trial and JNOV were denied. Additionally, the plaintiff's motion to stay, strike or tax the defendantsÆ memorandum of costs was denied. The defendants were awarded $523,592 in costs.</P>
