Facts

Actor Martin Sheen, a member of the Screen Actors Guild, performed consulting services on the motion picture
"No Code of Conduct." The picture was produced by the defendant production company, Toddler Pictures Inc.,
and starred SheenÆs son, Charlie Sheen. The plaintiffs, the Trustees of the Screen Actors Guild Pension Plan,
brought this action against the defendant production company for additional pension and health contributions
for SheenÆs services as an actor, which the plaintiffs claimed were owing by the defendants.

Result

The court determined that Sheen performed consulting services on the motion picture as an independent contractor and therefore no additional pension and health contributions for such services as an actor were owed.

Other Information

A motion for summary judgment by the plaintiffs was denied as the existence of an independent contractor relationship was viewed as a question of fact.
