Facts
The plaintiff, a 60-year-old ophthalmologist, entered into a contract with the defendant, a medical group, whereby
he transferred to the group all his professional income and received in exchange payment of a salary and office
expenses. The plaintiff instituted the suit on account of the failure by the defendant to pay the agreed-upon
salary.
The defendant medical group contended that the plaintiff had not turned over all the
monies that he was obligated to remit, and accordingly, the defendant cross-complained for
those funds.
Settlement Discussions
The plaintiff submitted a demand of $75,000; the defendant offered $15,000.
Damages
The plaintiff sought payment of the salary that had been withheld. The defendant medical group, in its cross- complaint, sought to recover the amount that the plaintiff had earned but had failed to remit.

The jury determined that the plaintiff had breached his contract and on the cross-complaint awarded the defendant $100,360. The plaintiff has appealed.
