For several years, the defendant dermatologist had been treating the plaintiff, a 33-year-old African-American female for acne with Acutane. In June 1995 the defendant discontinued the Acutane treatment. In September 1995, the defendant recommended to the plaintiff that she have a chemical peel. He performed the chemical peel, resulting in slight hyper-pigmentation in patchy areas on her face. The plaintiff brought this action against the defendant based on medical negligence and malpractice theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $200,000. The defendant made a C.C.P. º998 offer of compromise for $75,000.

Injuries

The plaintiff claimed that she was left with slight hyper-pigmentation (darkening of the skin) on her face. Her subsequent treating physician recommended that she avoid sunlight. Per the defendant, with make-up it was impossible to tell that there had been any change in the plaintiff's skin color.
