In 1990, plaintiff Southridge Homes purchased an oil and gas lease from defendant Don Weir's successor, Jack Teberg. When the defendant assigned the lease/property to Teberg, he reserved the right to continue using structures in the lease for non-lease purposes. The plaintiff claimed that the defendant's uses constituted a nuisance according to the City of Huntington Beach citations. In 1994, the plaintiff bought the fee ownership rights on one of the four lots encumbered by the oil lease and demanded that the defendant vacate the lease property. The plaintiff brought this action against Don Weir and his oil corporation based on trespass, nuisance and interference with business theories of recovery.
