Facts

In 1990 Plaintiff, a 44-year-old teacher, presented to Defendant HMO with breast lump. A family practitioner, following a negative mammogram, did a skin-punch biopsy, designed to evaluate "skin." This test result was negative, and the physician advised Plaintiff that there was no problem. Two years later, an infiltrating ductal carcinoma in Stage III B was diagnosed with a substantial reduced expectation of long-term survival. The Plaintiffs patient, her husband, and children filed this lawsuit for medical malpractice and included the potential wrongful death issues.
