Facts

On July 16, 1993, Plaintiff, a 53-year-old marketing and sales consultant, rented a vehicle from Defendant, an automobile rental agency which specializes in renting second hand vehicles in less-than-desirable condition. While returning from a trip to Marin County with a car full of all of his belongings, the vehicle caught on fire at a gas station. Plaintiff pushed the automobile away from the gas station to keep it from blowing up the gas station. In the process he inhaled toxic fumes and fractured several of his teeth.
