Facts

This case involved a patient who was suffering from AIDS at the time of the subject incident, with a life expectancy of 3-5 years maximum. On August 5, 1992, Defendant surgeon performed a pulmonary biopsy on this patient, to determine the nature of a persistent infection. He did so despite prior knowledge of a 24-minute, 30-second bleeding time, discovered in a pre-operative laboratory analysis. When the intrapulmonary bleeding began during the biopsy, Defendant was unable to stop the bleeding. As a result, the patient expired on the operating room table. He was 35 years of age and had made his living as a realtor. Plaintiffs were the patient's parents.

Settlement Discussions

Plaintiffs contend they demanded $150,000 and Defendant offered $50,000.
