Facts

In December 2003, Janice Miller, 58, was crossing Columbus Street in San Francisco in the crosswalk, which was near her condominium. She was struck by a van owned by defendant SBC IP Communication Inc. Miller died at the scene. Miller's husband James and their three adult children sued the defendant for wrongful death, alleging vehicular negligence. The defendant stipulated to liability, but disputed the extent of the plaintiffs' damages.

Damages

Miller earned $120,000 per year as a healthcare computer consultant and was the primary source of income for her household. Her husband was disabled as a result of an industrial accident.

Other Information

The case was settled for $5.3 million at a mediation before Coleman Fannin of JAMS.
