On Dec. 28, 2004, defendant Valeliano Langi Taufahema was operating a Bobcat tractor. The bucket of the Bobcat was in a fully raised position and came crashing down on plaintiff Nafetalai Tukia Veikoso, crushing him.
Injuries
The plaintiff suffered multiple spinal fractures, pelvic fracture and replacement, internal bleeding, infections, and scarring.
Result
The parties settled for $1 million (policy limits), one day prior to the C.C.P. Section 998 offer to compromise expired.
