Facts
The decedent presented to his family practitioner with complaints of lower back pain after lifting a car battery three days prior; stomach pain, constipation and pain radiating in the right testicle. He was diagnosed with lower back strain and was sent home and only urine tests had been performed. Later that afternoon, the decedent suffered an abdominal aortic aneurysm and was taken to Ojai Valley Emergency Room after his wife had telephoned 911. Resuscitation failed and the decedent was pronounced dead the same afternoon. Ultrasound showed a ruptured abdominal aortic aneurysm. The plaintiff acting individually and as the personal representative of the decedent alleged medical negligence, failure to diagnose and or treat and wrongful death.
