The plaintiff, a 12-year-old student in a sixth grade math class at Fremont Intermediate School (operated by the defendant Oxnard School District), and conducted by the defendant teacher, was misbehaving in class. The defendant teacher told the plaintiff pupil to stay after class. The plaintiff refused. The defendant teacher prevented the plaintiff from leaving the classroom and a brief scuttle took place. The defendant restrained the plaintiff and put him in a chair.
