Facts

The plaintiff, a 70-year-old homemaker, was rear ended on Oct. 7, 1999 at the intersection of Hillside Boulevard and Olivet Parkway in Colma. The plaintiff argued that her injuries were as a result of the accident which was caused solely by the defendant's negligence. The defendant contended that the plaintiff started on a green light but then stopped for no reason.

The plaintiff claimed that the accident had aggravated pre-existing arthritis in the lumbar facet joints and that the aggravation was caused by the accident and that there was no hope for any further improvement and that the symptoms were permanent. The defendant's expert testified that the plaintiff sustained a lumbar strain which resolved in six to eight weeks.

Result

The jury awarded the plaintiff $4,980 after finding the defendant 100 percent at fault.
