On Aug. 8, 1996, the 31-year-old plaintiff, presented to the defendant hospital in premature labor. The defendant Willie Brown Jr., M.D. asked the defendant Elizabeth Woods, M.D. to perform an ultrasound and amniocentesis, which confirmed a viable baby. The defendant Brown took Bucio to surgery, where a C-section was performed with the defendant Woods assisting. The C-section was performed without any complications or incidents. Following surgery, the instrument count was noted to be correct twice. The plaintiff and her baby were discharged. Approximately three years later, the plaintiff began to complain of abdominal pain. She sought medical attention and a surgical clamp was discovered in her pelvis. The clamp was removed but due to damage caused by the clamp, her right kidney was subsequently removed.

Settlement Discussions

The defendant Dr. Woods made a C.C.P. Section 998 offer for a waiver of costs.

Damages

The plaintiffs waived any wage loss claim to avoid any mention that they were undocumented immigrants.

Injuries

The plaintiff claimed that as a result of the defendant's malpractice, she had to undergo two additional surgeries, suffered the loss of a kidney and was in continuous pain. Her husband claimed loss of consortium.
