Facts

The plaintiff was a passenger in the defendant's car pool van and on his way to work at the time of the incident. They were driving in the car pool lane. A bus was disabled in the carpool lane ahead of them as a result of a flat tire. The defendant driver of the van did not stop in time to avoid the accident with the bus.

Settlement Discussions

The case settled on the first day of trial for a total of $350,000. The defendant van owner and driver paid $260,000 and the defendant bus company and driver paid $90,000.

Injuries

The plaintiff suffered abdominal trauma requiring a small bowel resection (resulting in a permanent scar on the stomach), sub-conjunctival hemorrhage and posterior vitrious detachment of his eye (permanent) and a sub-capital fracture of the fifth metacarpal of the right hand (permanent).
