Facts

On Aug. 4, 2000, the plaintiff tripped and fell over a raised paver at the top of the step that led
from the Redondo Beach Pier area to the Village Apartments in Redondo Beach. The pathway
was comprised of concrete slabs to afford fire department and pedestrian access. The property
was owned by William Lyon and the easement allegedly maintained by the City. The slab was
raised approximately 1+ inches by roots from adjacent trees.

Settlement Discussions

The plaintiff submitted a demand of $175,000. The defendants made no offer.

Injuries

The plaintiff suffered broken wrist, fractured jaw and TMJ residuals.

Other Information

<M>The case was settled at mediation before Michael Moorhead on Sep. 20, 2001 for $115,000.</M>
