Facts

The plaintiff was employed by Capitol Drywall (nonparty in this action) as a drywall finisher and taper. The
plaintiff slipped and fell on Jan. 21, 2000 at around 7 a.m. when he arrived for work. He alleged that he had
slipped on plaster and/or plastic left on the ground by defendant, Quality Plastering, at a construction site for a
residential condominium project being developed by the defendant, Greystone Homes. By Capitol Drywall
placing drywall materials in a garage to one of the homes, the plaintiff was obliged to walk across the
construction site where Quality Plastering was working and where they had placed debris at the entrance to the
garage.
Following the plaintiffÆs slip and fall, the plaintiff applied for, and received, workerÆs
compensation benefits from Capitol Drywall. According to the plaintiff, Greystone Homes alleged
that co-defendant Pacific Line Clean-Up was obligated to clean up the debris, which caused
plaintiffÆs injuries.

Other Information

The plaintiff obtained an arbitration award of $365,000 against Quality Plastering, who has requested a trial de novo. Pacific Line Clean-Up settled for $7,500. The plaintiff has filed a Notice of Appeal.
