Facts
On Sep. 19, 1999, the plaintiff attended Sunday service at the defendant's church. The
defendant's church was setting up a special service. At the Sunday service, the minister was
urging the congregates to sign a sign-up sheet, which was located in the parking lot. Those who
signed would volunteer on various dates and times to assist with the special service. The table
was placed with approximately one foot of space between the tire stop and the front of the table
for people to stand and sign the volunteer sign-up sheet. After the Sunday service, the plaintiff
left the church and walked directly to the table were numerous other congregates were standing
around the table and signing the sign-up sheet. The plaintiff walked to the front of the table,
signed her name and then turned to the left to walk away. She took one step and tripped over the
tire stop, falling to her left. As a result, she struck her left shoulder, left hip and left thigh on the
pavement.
Settlement Discussions
Initially, the plaintiff demanded $350,000 while the defendant offered nothing. On June 13, 2001, a five-hour mediation was held before retired judge Michael Berg at ARC, resulting in a $225,000 settlement.

Injuries
The plaintiff sustained an avulsion fracture and greater tuberosity in her left shoulder which required a reduction. The plaintiff also sustained an intertrochanteric fracture of the left hip requiring open reduction and internal fixation with sliding nail plate and screws.
