Facts

On Dec. 5, 1998, the plaintiff, a 60-year-old homemaker, underwent an elective cosmetic surgical procedure
known as blepharoplasty to her upper eye lids. The defendant doctor used a medical device manufactured by
the defendant manufacturer to incise the eyelid tissue. However, no corneal shields were used to protect the
plaintiff's eyes. During the surgical procedure, the plaintiff's left cornea was lacerated at or about the moment
that the physician experienced a spark or flash from the hand-held incising electrode.
The plaintiff subsequently underwent a corneal transplant and an intra-ocular lens replacement. Post cornea
transplant residuals consist of light sensitivity, blurriness and pain.

Damages

The plaintiff's husband claimed loss of consortium.
