The plaintiff claimed she walked into an open manhole on a sidewalk, in day light. The plaintiff also claimed the cover had been missing since October 1997 and the accident occurred in April 1998. The defendant claimed there was no notice of this condition and if the cover was off, it was still and open and obvious, and plaintiff could not have walked into the hole as she described.

Injuries

The plaintiff suffered closed head trauma, soft tissue injuries and TMJ.
