On July 29, 1999, at approximately 9 a.m., the 82-year-old plaintiff was walking through a parking structure on her way to a doctor appointment in the adjacent medical building. The defendant drove past plaintiff, stopped suddenly, and then started backing up the driveway. As he did so, he knocked down plaintiff onto her right hip and ran over her right foot. Hearing plaintiff's screams, defendant stopped and exited his car. Once he realized that the car was parked on her right foot, defendant returned to his car and rolled it off plaintiff's foot. The plaintiff contended that the defendant was negligent in the operation of a motor vehicle and that all of plaintiff's claimed injuries were a direct result of the trauma she sustained in the accident.
Injuries
The plaintiff suffered contusions, lacerations and bleeding of the inner and outer right leg, requiring surgical repair. She also suffered abrasions to the left foot.
Other Information
The $100,000 settlement consisted of insurance policy limits of $25,000 from the third party and $75,000 from plaintiff's own underinsured motorist policy.
