Plaintiff and defendant both insured "Builder." Builder built a "spec" home in Laguna Beach.
The home was purchased by the claimant family, which brought a claim against Builder for alleged water
infiltration throughout the home. This water infiltration allegedly resulted in continuous damage to the property
and physical injury to the claimantÆs young son.
The plaintiff settled the claim prior to litigation for $225,000. At that point the plaintiff sued the defendant for
contribution.

Settlement Discussions

The plaintiff demanded $110,000. The defendant did not make any counter-offer.
