Facts

Plaintiff, Daniel Dashiell, a 29-year-old was riding his motorcycle in the city of Glendale when he hit a depression in the road that was filled with water. Dashiell lost control of the motorcycle and hit a vehicle driven by co-defendant Thomas Smith, who admittedly, failed to yield at a stop sign. Plaintiff filed an action for negligence against Glendale and Smith.

Settlement Discussions

The plaintiff made an offers of judgment for $750,000 and $700,000, and an offer to arbitrate the matter. The defendant made a settlement offer of $50,000.
