Facts
On Jan. 6, 1998, plaintiff Ramon King, a child, was injured while she was walking with other children
from the University of California at Santa Barbara ChildrenÆs CenterÆs day care program. The children were
accompanied by two teachers. As the group walked past a pile of palm fronds next to a path on unimproved
portions of the UniversityÆs West Campus, plaintiff tripped and fell, impaling his right knee on the sharp tip of a palm frond.
Damages
After the palm frond was removed from plaintiff in the hospital emergency room, portions remained within the internal knee area, resulting in chronic synovitis. Three subsequent surgical procedures were necessary to remove all remaining frond fragments.
