Facts

On March 14, 1998, at 12:45 p.m., plaintiff slipped and fell on a liquid near the cash registers at the El Cajon
Wal Mart store. Two customer-witnesses said the liquid was approximately two feet in diameter, dirty, and
with numerous shopping cart tracks through it. Wal Mart employees described the liquid as clear and clean.
