Facts

On Sept. 7, 1998, plaintiff, a 42-year-old retired army officer, was at the check out stand paying for groceries
when a panel from the check out stand disengaged and fell on his left foot. Plaintiff was initially diagnosed
with a contusion to the left foot, but his condition deteriorated, and he was eventually diagnosed as suffering
from reflex sympathetic dystrophy (RSD) syndrome to the left foot.
The plaintiff underwent a course of treatment which involved three nerve blocks via epidural injections. The
nerve blocks were ineffective. Plaintiff presently suffers from debilitating pain to the left foot.
