Facts
On March 31, 1996, at 10:30 p.m., plaintiff Tae Eo was on his way home from work when his vehicle stalled in the No. 1 lane on Olympic near Centinela Avenue. Tucker was directly behind Eo and Goldich was behind Tucker. Liability was in dispute as there were conflicting reports as to whether Goldich hit Tucker first and pushed him into Eo's car or if Tucker first hit Eo and then Goldich rear ended Tucker. The plaintiff brought this action against the defendant based on negligence. Per the defendant, the plaintiff testified he felt only one impact.
Settlement Discussions
The plaintiff º998 settlement demand of $5,000. Defendant Tucker made a C.C.P. º998 offer of compromise of $3,500 to Eo, and defendant Goldich made no offers.

Defendant Goldich also cross-complained against Tucker for his property damage, but recovered nothing.
