Facts

The I-5 highway improvement project allegedly required the acquisition of 12,117 and 11,954 square feet from a
640,048 square-foot hotel, office and restaurant site. There was one off-ramp before the project and two off-
ramps and two on-ramps after the project. There were temporary ramp and street closures, plus detours during
the construction project. The adjacent street was reconfigured and driveways were matched to the street. The
restaurant business claimed it was impacted from the construction and the taking.

Settlement Discussions

The plaintiff offered $100,000, but the defendant demanded $150,000.

Damages

The defendant contended that the construction project caused a $400,000 loss of goodwill.
