The plaintiff claimed an injury to her common bile duct while undergoing laparoscopic cholecystectomy. The
injury to the common bile duct was discovered several days post-op and plaintiff was transferred for repair
surgery to Loma Linda University Medical Center. The plaintiff underwent repair surgery which was
complicated by the development of a biloma involving the liver. This was successfully drained percutaneously.
The plaintiff claimed residual damages, including a fear of pregnancy, scarring abdominal discomfort with
limitations on her activities of daily living. Additionally, she had a fear of future surgery.

PlaintiffÆs last demand was $175,000.

The plaintiffÆs husbandÆs loss of consortium claim was dismissed on the eve of trial. After three-quarters of one day of deliberation, the jury informed the court that they were unable to reach a verdict. However, they were told to return the following day for further efforts.
