Facts

On Nov. 5, 1999, the plaintiff, age 37, was working in the front yard of her home when she observed that her
neighborÆs Chow dog had gotten loose and was roaming the street. The Chow then approached her Labrador
Retriever on her driveway and started to fight with the plaintiffÆs dog.
The plaintiff, in fear of the Chow killing her animal, attempted to break up the fight. The Chow then turned on
the plaintiff, grabbing onto her right hand and throwing her to the ground. The defendant commenced spraying
her dog with a water hose in order to stop the attack.

Settlement Discussions

The plaintiff made a C.C.P. Section 998 demand of $125,000. The defendant offered $20,000.
