On June 3, 1999, the plaintiff, a 65-year-old retired general manager of the Mojave Water Agency and a civil
engineer, was on a walkway which had an unmarked single step riser. He did not see the step and fell,
sustaining a right tibial plateau fracture through the tibial spine, a left distal radius and an ulnar styloid
fracture.
