Facts

The decedent, 26, was killed at a
construction site in a trench cave-in.
The decedent was survived by a wife
and three children. The plaintiffs
contended that the accident was caused
by poor soils conditions and the failure
to properly shore and brace the trench.
The defendants contended that the
plaintiff and all workers were instructed
not to go into the trenches being dug by
a backhoe and that the area was "off-
limits."

Other Information

The decedentÆs wage loss and loss of earning capacity was waived due to his undocumented status.
