Facts
On Aug. 13, 1999, at the Hollywood Bowl, defendant Mario Gonzalez, an employee of defendant Grant Parking,
falsely reported to police officers that a car driven by the plaintiff struck him and fled the scene. As a result of
that false report, a criminal complaint was filed against the plaintiff.
One year prior to the incident in question, Mario Gonzalez falsely reported to police officers that he had been
struck by Edward Barner, another Hollywood Bowl patron. After a jury trial, all charges were dismissed
against the plaintiff.
Settlement Discussions
The plaintiff demanded $120,000. The defendant offered $20,000.

According to the defendant, Gil Mileikowsky, DamgaardÆs boyfriend, alleged that he was assaulted by Gonzalez, suffering severe emotional distress. Mileikowsky, an OB/GYN, did not seek treatment for his alleged injuries although he testified to treating himself.
