Facts
According to the plaintiff: On March 15, 1999, the plaintiff, 39, while in the course and scope of his employment
as a driver with defendant Citi-Wide Preferred Couriers, was operating a vehicle southbound on the Interstate
405 (San Diego freeway) when he was struck by a vehicle which had been involved in a police chase. The
plaintiff suffered injuries as a result of the accident. The plaintiffÆs employer failed to provide either auto or
health insurance.
Moreover, Citi-Wide failed to carry workerÆs compensation insurance which would have provided coverage for
the plaintiffÆs injuries and damages.
The plaintiff brought this action against the defendant based on violation of Labor Code section 3706 for
failure to carry workerÆs compensation insurance.
The defendant contended that the owner of the vehicle should have provided insurance; that plaintiff should
have had his own auto and health insurance.
