The plaintiff was stationary at a stop light when his truck was struck from behind by a van driven by the
defendant driver in the course and scope of his employment with the co-defendant. The defendant admitted
liability, the remaining issues being the extent of the plaintiffÆs injuries and resulting damages. The plaintiff
claimed to have suffered a permanent herniation of the T10-11, L4-5 and L5-S1 with resulting intermittent pain
in the abdomen, left leg and foot.
The defendant claimed that the herniations were pre-existing based upon MRI evidence, but did not dispute the
post-accident onset of the plaintiffÆs pain or past medical expenses.
The defendant disputed future surgery estimates because there was no clear opinion of
medical certainty and past lost wages because the plaintiff immediately returned to work, and
later resigned for another reason, and future wage loss because there was no medical restriction
to work less.
