Facts
On May 18, 2000, the plaintiff, a 40-year-old female flight attendant, received a chiropractic adjustment to the
cervical spine on May 18, 2000 from the defendant. Within 30 to 45 minutes, she experiences symptoms of
nausea, dizziness and right side weakness. She contacted the chiropractor who advised her to go to the hospital
emergency room to allay her concerns. She went to ER on May 19 and was diagnosed with a stroke.
Damages
The plaintiff claimed a total of $1.8 million in damages, including loss of earning capacity, past and future pain and suffering and loss of consortium.
Injuries
Alleged stroke, residual side weakness with disturbance in the gait.
Other Information
The parties mediated this case before Robert Altman on Feb. 14, 2002, which failed to resolve the case. Before trial, the defendant made a C.C.P. Section 998 offer of $300,000. On the first day of trial, the defendant increased his offer to $400,000. The plaintiffs rejected this offer and demanded $500,000.
