The plaintiff, Bart Cox, was stopped on Interstate 280 and was injured when his car was rear-ended by the
defendant Calk, an employee of Tadco Supply. The plaintiff was 41 years of age at the time of the incident and
a computer engineer.
The impact was above 20 mph and caused seat-back failure in addition to rear end damage.
