Facts

On Feb. 9, 2001, the plaintiff was walking in a common area shared pursuant to a written agreement between two apartment building complexes owned by two separate owners. The plaintiff slipped on debris that fell from trees located on the defendant X property. The fall took place on property owned by Y property, but shared between two properties by a written agreement.

Settlement Discussions

The plaintiff made a C.C.P. Section 998 demand of $200,000; the defendants offered $60,000.

Injuries

The plaintiff, a 67-year-old female sustained a fractured hip which resulted in a hip replacement.
