The decedent, Alan Barno, 39, was killed instantly in an auto accident early in the morning of May 4, 2001, when he was driving to work on Bear Valley Parkway in Escondido. Driving in the other direction was an independent contractor newspaper carrier who had just completed her deliveries of the Union Tribune newspaper in Rancho Bernardo. The newspaper carrier lost control of her vehicle, causing it to flip over, crossing the center divider and striking the roof of Barno's vehicle, killing him instantly.

The plaintiff submitted a demand of $4.5 million. A demand of $1.8 million had been submitted previously but had been withdrawn. The defendant offered $500,000 initially and subsequently increased to $750,000 on the second day of trial, but this was rejected by the plaintiff.
