On Jan. 31, 2001, the plaintiff, 71-year-old Joan Cameron, and her 13-year-old granddaughter, Amber, were rear-ended on a freeway offramp by the defendant Art Phan, an Orange County Public Defender. Amber Cameron sought medical care the next day at Kaiser for a sprained ankle and required crutches for five days. She had no further care until five months later when her grandmother took her to the chiropractor with complaints of back and neck pain. She was then treated for six weeks. Joan Cameron did not see a physician for six weeks following the incident. She was at her Kaiser doctor for a heart problem and mentioned the accident. The doctor prescribed pain medication. Her next care was not until May 31, 2001 when she saw Dr. Drevo for the first time. He treated her for 61 visits through December 2001.
